Oracle appeals $306 mn settlement in SAP lawsuit

US software giant Oracle is appealing a $306 million settlement in its marathon copyright infringement lawsuit against German rival SAP, court documents show.

The current settlement amount, set on August 3, is less than a quarter of the $1.3 billion SAP had been originally ordered to pay the Silicon Valley giant by a jury in November 2010.

But US District Court Judge Phyllis Hamilton slashed the amount last year to $272 million, saying the jury’s award was “grossly excessive”.

Oracle rejected the amount and made its case through the courts.

The case dates back to 2007, when Oracle accused SAP subsidiary TomorrowNow of a massive scheme to download and copy its software.

Last month, the two firms agreed to the $306 million figure — but with the understanding that it was simply a maneuver to end the case in the lower courts and allow an appeal to proceed.

The latest appeal was made to the Ninth Circuit Court of Appeals.

Jay-Z joins Pearl Jam on stage for ’99 Problems’

PHILADELPHIA (AP) — Pearl Jam has closed the two-day Budweiser Made In America Festival, but not before the man who put it all together joined the band on stage.

After frontman Eddie Vedder thanked Jay-Z for the festival, the megastar came out and joined the group for a rocking version of “99 Problems.”

Pearl Jam performed an intense 25-song set that saw tens of thousands of fans jumping, dancing, and singing to its well-known tracks including “Alive,” ”Better Man,” and “Jeremy.” The group also covered the Clash’s “Know Your Rights,” and The Who’s “Love Reign O’er Me.”

Fittingly, the band ended with Neil Young’s “Keep on Rockin’ in the Free World.”

In keeping with the festival theme, Vedder said he wants to see more made in America wares and encouraged people to vote.

‘Marvel’s The Avengers’ Passes $1.5B Mark

Given that the Walt Disney Co announced its $4 billion purchase of Marvel three years ago almost to the day, that price tag looks like a bargain after Summer 2012. Because Marvel’s The Avengers in its 19th week of global release has passed $1.5 billion in worldwide theatrical grosses through Sunday. It’s now the world’s 3rd biggest movie of all time (not adjusted for inflation or higher ticket prices or 3D premium sales) behind only #2 Titanic (1997) and #1 Avatar (2009).

After Disney re-released the superheroes assembly actioner into 1,705 locations this weekend, it took in another $1.7M in North America. Its 4-day Labor Day holiday domestic take is estimated at $2.2M. That puts its domestic cume through Sunday at $619.5M and through Monday at $620.1M. Its estimated international gross through Sunday is $882.3M. For a new global cume through Sunday of $1,501.8M.

Toronto 2012: Festival Tells Paparazzi to RSVP as Part of New Red Carpet Protocol

No more herding cats: Camera crews and stills photographers will be ushered into pre-selected positions on the red carpets.

TORONTO — The Toronto International Film Festival will this week demand order from the relentless paparazzi bellowing the names of Hollywood stars on the red carpet or at press conference photo calls.

Ahead of opening night for TIFF’s 37th edition this Thursday, fest organizers unveiled a new website where pre-approved photographers are told to RSVP for a presence on the red carpets outside Roy Thomson Hall and other prestigious venues.

And the paparazzi will be assigned positions from which to snap A-list stars launching their latest movies in Toronto.

At Abercrombie & Fitch, Sex No Longer Sells

Abercrombie & Fitch’s (ANF) skin-filled ads and nightclub vibe once delighted American teenagers and infuriated parents. Today, many aren’t even paying attention. The once-edgy retailer has lost a third of its market value in the past year as it grapples with falling sales in Europe and the U.S. While Abercrombie blames the economy for its woes, brand consultants say it also has failed to change with the times.

Today’s teens are underwhelmed by the half-naked models and blaring, dimly lit stores. They’re also less inclined to wear Abercrombie’s longtime uniform of pricey denim and graphic T-shirts. “The trick for fashion brands is how to keep the core edgy and hot,” says Allen Adamson, a managing director at brand consulting firm Landor Associates.
